1. General
By placing an order with Mr Oyster (referred to as "we," "us," or "our"), you ("the Customer") agree to be bound by these Terms and Conditions.2. Products and Availability
- Perishable Goods: All products, including fresh fish and caviar, are perishable food items. We make every effort to display products and their descriptions accurately. However, product images are for illustrative purposes, and the actual product may vary slightly.
- Stock: All orders are subject to availability. If an ordered item is out of stock, we will contact you to offer an alternative or a full refund for that item.
- Quality Guarantee: We specialise in providing the highest quality fresh and chilled seafood. Our quality guarantee is strictly limited to the condition of the goods upon arrival and is subject to the terms in the Return and Refund Policy.
3. Orders, Pricing, and Payment
- Contract Formation: A contract for the sale of products is formed only when we dispatch your order and send you a dispatch confirmation email.
- Pricing: All prices are as listed on the website at the time of order and include VAT (where applicable). We reserve the right to change prices at any time, but this will not affect orders already confirmed.
- Payment: Payment must be made in full before the order is dispatched.
4. Delivery
- Delivery Conditions: We utilise specialised temperature-controlled packaging and delivery services to maximise the freshness and quality of your perishable goods upon arrival.
- Customer Responsibility: It is the Customer's sole responsibility to ensure a recipient is available at the provided delivery address to receive and immediately refrigerate the perishable goods.
- Failed Delivery: We are not liable for any spoilage or damage resulting from a failed delivery attempt or delay due to the Customer's failure to provide accurate delivery information or to be present to receive the goods.
5. Liability
- We exclude all liability for any loss, damage, or expense (including indirect or consequential loss) unless it arises directly from our negligence or wilful misconduct. Your statutory rights are not affected.
- Royal Mail operations;
- weather conditions;
- strikes;
- or other circumstances beyond our control.
